18 U.S.C. § 2257 Compliance Notice

01 Scope

All models, actors, actresses, and other persons who appear in visual depictions of actual or simulated sexually explicit conduct on this website or in related services of Flixsell LLC were over the age of eighteen (18) years at the time of the creation of such depictions.

Some visual depictions displayed on this website are exempt from the requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 because they do not portray conduct as defined in 18 U.S.C. § 2256(2)(A)–(D); do not portray genitals or the pubic area exposed or partially covered; were created prior to July 3, 1995; and/or because the operator of this website is not a “producer” with respect to the creation of the content.

02 Custodian of Records

To the extent the operator may be considered a “producer” under 18 U.S.C. § 2257 with respect to visual depictions of actual sexually explicit conduct on this website, the records required under 18 U.S.C. § 2257 and 28 C.F.R. Part 75 are maintained by the Custodian of Records:

03 Third-Party Content

FlixSell is a platform on which independent Creators (“Uploaders”) make digital files available to Buyers. Where content is created and uploaded by third parties, those Uploaders alone are responsible for complying with all applicable record-keeping obligations — including 18 U.S.C. § 2257 and related regulations — and for ensuring that every depicted person was at least 18 years of age at the time of creation.

Flixsell LLC does not produce such third-party content and relies — to the extent permitted by law — on the representations, age-verification duties, and contractual obligations of the Uploaders. Records relating to content created by Uploaders are maintained by the respective producer or by the custodian designated by that producer.

Under the FlixSell Terms of Service, Uploaders are required to obtain identity and consent documentation for depicted persons, retain it for at least seven (7) years or the period required by law, and produce it to FlixSell upon request.
